Coming to the US

Daniel Lozano-Camargo entered the US in 2022 as an unaccompanied minor from Venezuela seeking asylum.  He initially spent time in a facility for underage migrants until he turned 18.  According to Politico, he was subsequently twice arrested for possession of cocaine, with the most recent last November.  He was sentenced to 120 days in prison in January.

Detention and Expulsion

From there Daniel was transferred to ICE authority which filed an application for his detention claiming he was in the country illegally.  In March it was confirmed he was one of the men expelled to CECOT, claiming he was a member of Tren de Aragua due to his tattoos which include the name of his father, his partner’s daughter’s name, his niece’s name, a crown with the letter E, praying hands, date of his anniversary, and the words “King of Myself.” Daniel’s family members deny that he has gang affiliation.

Judge rules Daniel’s return must be facilitated

In April, Federal Judge Stephanie Gallagher ruled that the administration deported a 20 year old Venezuelan man (now known to be Daniel) in violation of a legally binding, court approved settlement agreement reached in a lawsuit last year.  In that settlement, the US agreed not to deport migrants who arrived as unaccompanied minors until their asylum claims are fully adjudicated.  She ordered the administration to facilitate Daniel’s return. The administration has so far not complied.
